Deborah E. Palter
PRACTICE
Deborah Palter practices in the area of commercial litigation with an emphasis on contract disputes, banking litigation and creditors’ rights. She regularly acts for major financial institutions and professional accounting firms providing advice on insolvency related litigation issues. She is experienced in matters relating to breach of contract, breach of fiduciary duty, oppression, shareholder disputes and real estate disputes.
Ms. Palter has trial and appellate experience and regularly attends on matters before the Ontario Superior Court of Justice (Commercial List). She has appeared as counsel on interlocutory proceedings, including motions for injunctive relief, security for costs and summary judgment. Ms. Palter’s experience with alternative dispute resolution includes arbitrations and complex multi-party mediations.
Ms. Palter appeared as counsel to the Receiver, RSM Richter Inc., in connection with the Norshield hedge fund scandal (Canada’s second largest hedge fund scandal). She assisted in the representation of contesting bondholders in the BCE privatization proceeding. The case concerned the world’s largest leveraged buy-out and sped through three levels of Court, including the Supreme Court of Canada, in less than 9 months.
Ms. Palter was called to the Bar of Ontario in 1996 and admitted to practice in the State of New York in 1997.
PROFESSIONAL INVOLVEMENT
Ms. Palter has been an articling principal and student mentor for many years. She is a member of the Ontario Bar Association, Canadian Bar Association and the Advocates' Society.
EDUCATION
Ms. Palter obtained a Bachelor of Arts (Honours) in English and Political Science from the University of Toronto in 1991. She obtained a Bachelor of Laws from the University of Windsor and a Juris Doctorate from the University of Detroit (Mercy) in 1994. She is a past winner of the American Jurisprudence Award for excellent achievement in the study of sales and commercial transactions.
